1Acceptance of Terms

By accessing or using Hailuo AI Video (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We may update these Terms from time to time. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

2Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

You must be at least 13 years old to create an account and use our Service.

3Use of Service

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Upload or generate harmful, offensive, or illegal content
• Attempt to gain unauthorized access to our systems
• Use the Service to generate spam or misleading content
• Reverse engineer or attempt to extract source code
• Use automated tools to access the Service without permission

4Content Ownership

You retain ownership of any content you create using our Service, including prompts, images you upload, and videos you generate.

By using our Service, you grant us a limited license to store, process, and display your content as necessary to provide the Service.

You are solely responsible for ensuring you have the right to use any content you upload to our Service.

5AI-Generated Content

Content generated by our AI models is provided "as is." While we strive for quality:

• We do not guarantee the accuracy or suitability of generated content
• Generated content may require review and editing before use
• You are responsible for reviewing content before publishing or sharing
• AI-generated content should not be used for illegal purposes

6Prohibited Content

You may not use the Service to create, upload, or generate content that:

• Is illegal, harmful, or promotes violence
• Contains explicit sexual content, nudity, or NSFW material of any kind
• Promotes discrimination or hate speech
• Infringes on intellectual property rights
• Contains personal information without consent
• Is designed to deceive or defraud others
• Depicts minors in any inappropriate, sexual, or romantic manner
• Depicts non-consensual acts (including kissing, touching, undressing, or sexual contact directed at a fearful, struggling, sleeping, drugged, or otherwise non-consenting subject)
• Depicts gore, corpses, necrophilia, self-harm, or suicide

We reserve the right to remove any content that violates these terms and terminate accounts of repeat offenders.

7NSFW Content and Account Termination

We operate a strict zero-tolerance policy for NSFW (Not Safe For Work) and other prohibited content described in Section 6. This includes — but is not limited to — sexually explicit material, nudity, non-consensual or coercive scenes, content involving minors in any inappropriate context, and gratuitous violence or gore.

Our system performs automated content moderation on every prompt before generation. Submitting prohibited prompts is itself a violation of these Terms, regardless of whether the request was blocked or completed.

If we determine that you have used the Service to attempt or complete the generation of prohibited content, the following actions may be taken at our sole discretion:

• Permanent termination (ban) of your account and any associated accounts
• Immediate forfeiture of all unused credits, remaining subscription time, and any other balances
• No refund will be issued for any prior purchases, including subscription fees, credit purchases, or pay-as-you-go payments
• Removal of any content generated through the Service
• Reporting to law enforcement where required by applicable law (including, without limitation, content depicting minors)

By purchasing credits or a subscription, you acknowledge and agree that violations of this policy result in immediate termination without refund. This is a material term of your purchase.

8Payment Terms

Certain features of the Service require payment. By purchasing credits or subscriptions:

• You agree to pay all fees and applicable taxes
• Payments are processed securely through Stripe
• Credits are non-transferable and have no cash value
• Subscriptions auto-renew unless cancelled

9Refund Policy

We offer refunds under the following conditions:

• Subscription refunds: Within 7 days of purchase if unused
• Credit purchases: Non-refundable once credits are used
• Technical issues: Case-by-case basis for service failures
• Policy violations: No refund of any kind will be issued for accounts terminated for violating our Content Policy (see the NSFW Content and Account Termination section)

10Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may:

• Perform scheduled maintenance with advance notice when possible
• Experience occasional downtime due to technical issues
• Modify or discontinue features with reasonable notice

11Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAILUO AI VIDEO AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you paid to us in the twelve months preceding the claim.

12Indemnification

You agree to indemnify and hold harmless Hailuo AI Video and its affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13Termination

We may terminate or suspend your account at any time for violation of these Terms. Upon termination:

• Your right to use the Service will cease immediately
• Unused credits may be forfeited
• We may delete your content after a reasonable period

You may terminate your account at any time by contacting us.

14Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

Any disputes arising from these Terms shall be resolved through good-faith negotiation or, if necessary, through binding arbitration.
